These Terms of Service (“Terms”) apply to educators, teaching assistants, administrators, and institutions using Purple Crayon (the “Service”). By using the Service, you confirm that you have the authority to agree to these Terms on your own behalf, or on behalf of your institution when applicable.

If you do not agree to these Terms, please do not create an account or use the Service.

2. Accounts and educator responsibilities

• You must provide accurate information when creating an account, including your name and institution.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You agree to notify us promptly of any unauthorized access or suspected security issue.

3. Student work and privacy

Purple Crayon processes student writing, rubric definitions, and evaluation data solely for the purpose of providing the Service to you and your institution. We treat student work as sensitive educational data.

• We do not sell student work or evaluation data.
• We do not use student work to train public, broadly available models.
• You are responsible for ensuring that your use of the Service complies with your institution’s policies and applicable laws.

4. AI-generated feedback and limitations

Purple Crayon uses AI models to assist with evaluating writing and drafting feedback. These models can make mistakes and should be treated as tools, not final authorities.

• You remain responsible for all grading decisions and feedback shared with students.
• You agree to review AI-generated suggestions before using them in your course.
• You should not rely on the Service for high-stakes decisions without human review.

5. Acceptable use

You agree not to use Purple Crayon to:

• Upload content that is unlawful, harassing, discriminatory, or otherwise inappropriate.
• Attempt to reverse engineer, circumvent security features, or gain unauthorized access to the Service.
• Build a competing product using confidential aspects of the Service.

We may suspend or terminate access if we reasonably believe these Terms are being violated.

6. Plans, trials, and billing

Some parts of the Service may be offered for free, while others may require a paid plan or institutional agreement.

• Where fees apply, they will be described in a separate pricing page, quote, or agreement.
• Trial access may be limited in duration or functionality.
• We may change pricing or plan structures in the future, but will communicate changes that affect your existing subscription.

7. Term, suspension, and termination

You may stop using Purple Crayon at any time and may request that your account be deleted.

• We may suspend or terminate access if you materially breach these Terms.
• Institutional agreements may include additional termination terms, which will control if different.
• After termination, we may retain certain records as required by law or for legitimate business purposes, but will handle them in line with our Privacy policy.

8. Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted or error-free.

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising out of or related to your use of the Service. Where our liability cannot be excluded, it is limited to the amount you have paid for the Service over the previous twelve (12) months, if any.
